Thanks for posting this, there are entirely to many people talking about this issue as if it's already been totally settled one way, or the other.
That said, as the law stands, and much as I've tried to explain to what seems like a million people, at this point, the 1st amendment has been traditionally seen to protect Youtube's right to filter content, rather than to protect content providers rights to post, or have posts be monetized.

Yes the outcome from this and future actions are far from settled. But I think Youtube is going to come under more and more scrutiny from governments besides the private legal actions.
